Tres Numeros Terms of Use

1. Overview of the Service

Tres Numeros is a minimalist personal finance and expense tracking application provided by Nedeveon EOOD ("we" or "us"), a company registered in Bulgaria. These Terms of Use ("Terms") govern your use of the Tres Numeros iOS app and related services ("Service"). By downloading or using the app, you agree to be bound by these Terms. If you do not agree, please do not use the app.

Tres Numeros allows you to track your personal finances primarily offline, with your data stored locally on your device. The core functionality of the app does not require an internet connection. Optional premium features (such as voice logging and photo logging of expenses) are available and require an internet connection and an active subscription. Access to premium features is managed using a unique, anonymous identifier stored securely in your device's Keychain, linking your subscription status without requiring a traditional user account.

2. User Eligibility and Conduct

You must use Tres Numeros in accordance with these Terms and all applicable laws. By using the app, you represent that you are legally capable of entering into this agreement (for example, you are an adult in your jurisdiction or have the consent of a parent/guardian). We do not impose specific usage restrictions, but we expect you to use the app responsibly and lawfully.

When using Tres Numeros, you agree not to:

• Use the app for any unlawful or fraudulent purposes.
• Attempt to interfere with the app's operation or access our servers without authorization.
• Reverse engineer, decompile, or otherwise tamper with the app or its code.

Failure to comply with these conduct requirements may result in termination or suspension of your access to the Service.

3. Premium Features and Subscriptions

Tres Numeros offers optional premium features, including voice logging of expenses and photo receipt logging. Access to these premium features requires purchasing a subscription via the Apple App Store. Your subscription status is linked to your device through a unique, anonymous identifier stored in your Keychain, not through a user account.

Subscription pricing and details (such as duration and renewal terms) are provided within the app and the App Store listing. All subscription purchases are handled through your Apple App Store account.

Important points regarding subscriptions:

• Payment: Subscriptions are purchased and billed through your Apple ID. Your account will be charged upon confirmation of purchase and will auto-renew at the end of the subscription period unless you cancel beforehand.
• Management: You can manage or cancel your subscription at any time through your Apple ID account settings on your device.
• Subscription Linkage: Premium features are enabled based on a valid subscription linked via the unique identifier stored in your Keychain. There is no separate Tres Numeros user account to manage. If you reinstall the app, it may be able to restore your premium access using the identifier stored in the Keychain, provided it still exists.

4. Refunds

Nedeveon EOOD does not provide refunds for subscription fees directly. All transactions for subscriptions are processed by Apple, and any refund requests must be made in accordance with Apple's App Store policies. This means that no refunds or credits will be issued by us for any unused portion of a subscription period, except as allowed by Apple or required by applicable law.

If you believe you are entitled to a refund, you should request it through Apple's refund process (for example, via the App Store or Apple Support).

5. Service Availability and Disclaimer of Warranties

We strive to keep the Tres Numeros service available and running smoothly. Premium features rely on our servers (hosted in Europe by Hetzner), and we aim for uninterrupted service. In the event of any disruption or downtime, we are committed to restoring service as quickly as possible. However, we cannot guarantee that the app or premium services will always be available, error-free, or meet your requirements.

Disclaimer: Tres Numeros is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. To the fullest extent permitted by law, we disclaim all warranties, whether express, implied, or statutory, including but not limited to implied warranties of performance, accuracy, reliability, merchantability, and fitness for a particular purpose. We do not warrant that the Service will be uninterrupted, secure, or free of errors, and we do not guarantee the accuracy or completeness of any financial data or calculations provided by the app.

6. Limitation of Liability

To the maximum extent allowed by law, Nedeveon EOOD (including its directors, officers, employees, and affiliates) will not be liable for any indirect, incidental, consequential, special, or exemplary damages arising out of or in connection with your use of (or inability to use) Tres Numeros or any of its features. This limitation applies to any loss of profits, loss of data, financial losses, or other damages, even if we have been advised of the possibility of such damages.

In jurisdictions that do not allow the exclusion or limitation of certain liabilities, our liability will be limited to the fullest extent permitted by law. In any case, if we are found liable for any claim, our total liability will not exceed the subscription fees you paid to us (if any) in the six months prior to the claim.

7. Governing Law and Jurisdiction

These Terms of Use and any dispute arising out of or related to the Service or these Terms will be governed by the laws of Bulgaria, without regard to its conflict of law principles. You agree that any disputes or claims shall be subject to the exclusive jurisdiction of the courts of Bulgaria.

If you use the app outside of Bulgaria, you are responsible for complying with any local laws applicable to your use.

8. Changes to These Terms

We may update or modify these Terms from time to time. If a revision is material, we will provide advance notice to you by posting the updated Terms within the app or through other appropriate means. By continuing to use Tres Numeros after any revisions come into effect, you agree to be bound by the updated Terms.
